Electronic Services Terms of Service

These Terms of Service set out the rules and conditions for using the "VanStev" website available at https://vanstev.pl, including the rights and obligations of the Service Provider and Users associated with the provision of electronic services. These Terms of Service have been prepared pursuant to the provisions of the Polish Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2020, item 344 as amended) and the Polish Civil Code of 23 April 1964. §1 Definitions • Service Provider / Administrator – "VAN STEV SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ", registered at: ul. Wspólna 7B, 45-837 Opole, Poland, Tax ID (NIP): 7543103819, REGON: 363216753, KRS: 0000591565 (District Court in Opole, VIII Commercial Division of the National Court Register), email: praca@vanstev.pl, phone: +48 664 186 710. • Website – the "VanStev" internet service operating at https://vanstev.pl and across all its subpages and language versions. • User – any natural person, legal person, or organizational unit without legal personality using the Website or Electronic Services. • Electronic Services – all services provided electronically by the Service Provider to Users via the Website, in particular: providing informational content, presenting job vacancies, operating contact and recruitment inquiry forms. • Contact Form – an interactive form enabling Users to submit business inquiries, job applications, and general correspondence to the Service Provider. • Civil Code – the Polish Act of 23 April 1964 Civil Code (Journal of Laws 2020, item 1740 as amended). §2 General Provisions 1. These Terms define: a) types and scope of services provided electronically, b) conditions for providing electronic services, including technical requirements necessary for cooperation with the ICT system, c) conditions for concluding and terminating agreements for the provision of electronic services, d) complaint procedure. 2. Using the Website is voluntary and free of charge for every User. 3. The User is obliged to comply with these Terms of Service from the moment of commencing use of the Website. 4. Content published on the Website is for informational purposes only and does not constitute an offer within the meaning of Art. 66 of the Civil Code, but an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code. §3 Types and Scope of Electronic Services Provided The Service Provider provides the following Electronic Services via the Website: 1. Browsing and reading informational materials, blog posts, and company profile presentations of VanStev, 2. Browsing current job vacancies in Poland and abroad, 3. Access to an interactive Contact Form to send inquiries to the Service Provider, 4. Access to an interactive cookie consent preferences management panel. §4 Conditions of Service Provision and Technical Requirements 1. Proper use of the Website requires: a) a device with Internet access (computer, tablet, smartphone), b) a properly configured web browser supporting HTML5, CSS3, JavaScript, and cookies (e.g. Google Chrome, Mozilla Firefox, Apple Safari, Microsoft Edge), c) an active email account – when utilizing the Contact Form. 2. The Service Provider makes every effort to ensure 24/7 availability of the Website, but cannot guarantee uninterrupted service due to maintenance breaks or network failures beyond its control. §5 Rules for Using the Contact Form and Submitting Applications 1. A User submitting via the Contact Form is obliged to: a) provide truthful, up-to-date, and non-misleading information, b) refrain from submitting unlawful, defamatory content or content infringing third-party intellectual property, c) review and accept the provisions of the Privacy Policy. 2. Submitting a form constitutes consent to contact by the Service Provider to respond to the inquiry. 3. The Service Provider utilizes advanced anti-abuse and anti-spam mechanisms (including Cloudflare Turnstile and rate limiting). §6 Rights and Obligations of the Parties 1. The Service Provider undertakes to: a) provide Electronic Services with due diligence, b) protect personal data of Users in compliance with GDPR standards, c) handle complaints within deadlines stipulated herein. 2. The User is obliged to: a) refrain from actions that could disrupt Website operation (DDoS attacks, unauthorized penetration attempts, malware injection), b) use the Website in compliance with applicable law, good customs, and these Terms. §7 Liability of the Service Provider 1. The Service Provider is liable for non-performance or improper performance of Electronic Services under general rules of the Civil Code. 2. The Service Provider is not liable for: a) Website disruptions caused by Internet service providers, telecommunication failures, or force majeure, b) damages resulting from User non-compliance with these Terms, c) recruitment decisions made by foreign employers cooperating with the Service Provider. §8 Copyright and Intellectual Property 1. All rights to the Website, including intellectual property rights to the name "VanStev", domain vanstev.pl, website architecture, source code, copy, graphics, photos, and logos belong to the Service Provider or licensed third parties. 2. Copying, distributing, modifying, or using materials published on the Website without prior written consent of the Service Provider is prohibited and infringes copyright legislation. §9 Complaints Procedure 1. The User has the right to submit complaints regarding Website operation and Electronic Services. 2. Complaints must be submitted via email to praca@vanstev.pl or in writing to: VAN STEV Sp. z o.o., ul. Wspólna 7B, 45-837 Opole, Poland. 3. The complaint should include: a) name and contact details of the applicant, b) email address for correspondence, c) detailed description of the issue and date of occurrence. 4. The Service Provider will examine the complaint within 14 business days from receipt and notify the User of the outcome electronically. §10 Termination of the Service Agreement 1. The agreement for Electronic Services is concluded upon entering the Website and terminated upon leaving the Website. 2. In the case of contact form inquiries, the agreement terminates upon conclusion of correspondence or withdrawal of the inquiry. §11 Protection of Personal Data Rules governing the processing of personal data and cookies are detailed in the Privacy Policy and Cookie Policy, which constitute an integral part of these Terms and remain accessible on the Website. §12 Final Provisions 1. These Terms enter into force upon publication on the Website. 2. The Service Provider reserves the right to amend these Terms in response to statutory changes or technical modifications. Amendments take effect upon publication. 3. Matters not governed herein shall be subject to applicable provisions of Polish law, in particular the Civil Code and the Act on the Provision of Electronic Services. 4. Any disputes between the Service Provider and a non-consumer User shall be submitted to the common court having territorial jurisdiction over the Service Provider's registered seat.
